TERMS AND CONDITIONS
Tech Trade Nation (PTY) Ltd.
Effective Date: 16 September 2026
Important: These Terms are intended to operate with applicable South African law. Where a mandatory legal right or remedy applies, that law takes precedence over any inconsistent provision in these Terms.
1. ABOUT THESE TERMS
1.1 What these Terms cover
These Terms govern:
use of the Tech Trade Nation website;
purchases made through the website, by quotation or by another accepted sales channel;
orders, payments and delivery;
cancellations, returns, refunds, repairs and warranty claims;
custom-built systems and related services;
trade-in transactions; and
other goods or services supplied by Tech Trade Nation.
1.2 Agreement to these Terms
By using the website, creating an account, placing an order, purchasing goods, submitting a trade-in or otherwise using our services, you agree to these Terms and any transaction-specific terms shown on the relevant product page, quotation, order confirmation, promotion or invoice.
1.3 Applicable law
These Terms are subject to the laws of the Republic of South Africa, including the Consumer Protection Act 68 of 2008 (CPA), the Electronic Communications and Transactions Act 25 of 2002 (ECTA), the Protection of Personal Information Act 4 of 2013 (POPIA), and other applicable legislation.
Nothing in these Terms is intended to waive, exclude, limit or misrepresent a right or remedy that cannot lawfully be waived, excluded or limited.
2. DEFINITIONS
For these Terms:
Business Day means a day other than a Saturday, Sunday or South African public holiday.
Customer means any person or entity that purchases or attempts to purchase Goods or Services, places or attempts to place an Order, submits a Trade-In, or otherwise enters into a transaction or agreement with Tech Trade Nation. Unless the context indicates otherwise, “Customer”, “you” and “your” refer to the relevant Customer.
Consumer has the meaning given to it by applicable South African law.
Goods means products supplied by Tech Trade Nation, including new, used, refurbished, open-box, ex-display and other products where identified as such.
Order means a request to purchase goods or services submitted by a customer.
Trade-In means a product submitted to Tech Trade Nation for cash, trade-in credit, purchase credit or another agreed consideration.
Website means the Tech Trade Nation website and related online ordering systems.
3. WEBSITE AND CUSTOMER ACCOUNTS
3.1 Lawful use
You may use the website only for lawful purposes and in accordance with these Terms.
3.2 Prohibited conduct
You may not:
attempt unauthorised access to our systems;
interfere with website security or operation;
introduce malware or malicious code;
manipulate prices, stock or product information;
submit fraudulent orders or use stolen payment information;
impersonate another person or knowingly provide materially false information;
abuse promotions, discounts, vouchers or referral systems;
use automated systems to interfere with ordering or scrape website content for unauthorised commercial purposes; or
use the website for unlawful, fraudulent or malicious purposes.
We may take reasonable steps to prevent or investigate fraud, abuse, cyberattacks and unlawful activity, including restricting an account or website access where reasonably necessary.
3.3 Account security
Where you create an account, you are responsible for keeping your login details secure and notifying us if you reasonably believe your account has been compromised.
4. PRODUCTS, SPECIFICATIONS AND COMPATIBILITY
4.1 Product information
We make reasonable efforts to keep product descriptions, photographs, specifications, pricing and availability accurate. Some information comes from manufacturers, distributors or suppliers and may change.
4.2 Manufacturer changes
A manufacturer may change components without changing the product model or model number. This can include processors, memory, storage, display panels, batteries, graphics processors, motherboards, power supplies, wireless adapters, ports, cooling systems, firmware and accessories.
Where a material difference exists between the goods supplied and what was represented at the time of sale, the matter will be handled in accordance with applicable law.
4.3 Product images
Images may be illustrative where this is clearly indicated. Colour, appearance and minor design differences may occur between an image and the supplied product where the product otherwise matches its stated specifications.
4.4 Compatibility
Where a purchase depends on compatibility with equipment already owned by the customer, the customer should verify compatibility before purchasing. This includes compatibility between CPUs and motherboards, RAM and motherboards, GPUs and power supplies, storage devices, operating systems, chargers, USB/USB-C devices, docking stations, monitors and networking equipment.
We may provide reasonable assistance where compatibility is uncertain, but the customer remains responsible for confirming suitability unless we have expressly agreed otherwise.
Nothing in this section limits a statutory remedy where goods fail to meet applicable legal requirements.
5. PRICING, STOCK AND ORDER ACCEPTANCE
5.1 Prices
All prices are in South African Rand unless expressly stated otherwise. Prices may change before an order is submitted.
5.2 Pricing errors
We take reasonable steps to prevent pricing errors. If an obvious or material pricing error occurs, including an unusually low price caused by a technical or administrative error, we may suspend or cancel the affected order to the extent permitted by law and refund any amount that must be refunded.
Where reasonably practicable, we will contact the customer before cancelling an affected order.
5.3 Stock
Website stock information may come from our inventory systems, distributors or suppliers and can change before an order is processed.
If goods become unavailable after an order is submitted, we will notify the customer and provide any remedy required by law or otherwise agreed.
5.4 Order acceptance
Submitting an order constitutes an offer by the customer to purchase the selected goods. An automated acknowledgement of receipt does not necessarily mean that the order has been finally accepted.
Before acceptance or fulfilment, an order may be subject to reasonable stock, payment, fraud, pricing, supplier and delivery checks.
Where permitted by law, we may decline or cancel an order for a legitimate reason, including suspected fraud, payment failure, material pricing error, unavailable stock or inability to fulfil the order.
6. PAYMENT AND PAYMENT PROVIDERS
6.1 Payment methods
Available payment methods may include EFT, credit cards, debit cards, instant electronic payments and third-party payment providers.
6.2 Payment verification
Orders are generally processed only after required payment has been successfully authorised or cleared. EFT proof of payment does not by itself confirm that funds have been received.
We may verify payment before dispatch.
6.3 Third-party payment providers
Where a third-party payment provider or buy-now-pay-later (BNPL) service is used, refunds and payment-plan adjustments may be processed through that provider and subject to its applicable procedures.
A refund may reduce an outstanding instalment balance or be returned to the original payment method, depending on the payment provider and transaction. Tech Trade Nation does not control the provider’s processing time after a refund has been submitted.
Where a BNPL transaction is refunded, the refund will not automatically be converted into store credit or an EFT merely because the customer prefers that method, unless Tech Trade Nation and the applicable provider agree otherwise and the law permits it.
6.4 Unauthorised payments
Customers must not use another person’s payment credentials without proper authorisation.
7. FRAUD, CHARGEBACKS AND TRANSACTION SECURITY
7.1 Fraud checks
We may conduct reasonable fraud and transaction-verification checks. An order may be delayed or reviewed where there are reasonable indicators of payment fraud, stolen credentials, identity theft, account compromise, suspicious transaction patterns, false information, fraudulent returns or promotional abuse.
We may request reasonable information needed to verify a transaction. We will not request passwords, PINs or authentication codes through insecure or inappropriate channels.
7.2 Chargebacks
If a customer initiates a chargeback or payment dispute, we may provide relevant transaction records to the payment provider or financial institution, including order details, invoices, payment records, delivery records, tracking information and relevant communications.
A chargeback does not itself determine whether the underlying claim is legally valid. Nothing in this section prevents a customer from exercising a lawful right.
7.3 Unlawful conduct
Where there are reasonable grounds to believe that a customer has engaged in fraud, theft, product substitution, payment abuse, identity fraud or other unlawful conduct, we may suspend the relevant transaction, preserve records, request verification, refuse further transactions where lawfully permitted and report suspected unlawful conduct to an appropriate authority where justified.
8. DELIVERY
8.1 Delivery estimates
Delivery estimates are estimates unless expressly guaranteed in writing.
Delivery may be affected by supplier delays, courier delays, stock availability, weather, public holidays, road conditions, remote-area delivery, infrastructure failures, industrial action, incorrect addresses, customs or regulatory requirements and other circumstances beyond our reasonable control.
8.2 Delivery information
Customers must provide accurate delivery information. Additional costs caused directly by materially incorrect delivery information may be charged where legally permissible.
8.3 Delivery failure or delay
Where an order is not delivered within the agreed period, the customer’s rights will be determined by the applicable agreement and legislation, including any cancellation or refund rights that may apply under ECTA or the CPA.
8.4 Risk and responsibility
Risk and responsibility for goods will be determined in accordance with applicable law and the nature of the transaction. Nothing in these Terms transfers a statutory responsibility to the customer.
9. CANCELLATIONS BEFORE DISPATCH
Where a customer cancels an order before it has been shipped, and the cancellation is otherwise permitted by the applicable transaction terms or law, Tech Trade Nation will refund amounts due to the customer.
Where no goods have yet been shipped, any delivery charge that has not actually been incurred will generally be included in the refund. Where a non-refundable third-party service or other charge has already been incurred, the treatment of that charge will depend on the applicable law and transaction terms.
10. STATUTORY ONLINE CANCELLATION AND COOLING-OFF RIGHTS
10.1 ECTA cooling-off right
Where section 44 of ECTA applies, a qualifying consumer may reverse the transaction within seven days after receipt of the goods, subject to statutory exclusions.
10.2 Return costs
The consumer may be responsible for the direct cost of returning goods where ECTA permits this.
10.3 Refunds
Where a statutory cancellation right applies, refunds will be made within the period required by the applicable law and generally using the original payment method or another lawful method agreed with the customer.
10.4 Website information and order review
For qualifying electronic transactions, we will provide the information and order-review mechanisms required by ECTA, including an opportunity to review the transaction and correct input errors before the order is finally placed. Where the law provides an additional cancellation right because these requirements were not met, that statutory right will apply.
10.5 Exclusions
The ECTA cooling-off right does not apply to every transaction or product. Statutory exclusions include certain personalised or made-to-specification goods, goods that cannot by their nature be returned, rapidly deteriorating goods, and certain unsealed software and other excluded transactions. Where an exclusion applies, the transaction will instead be governed by the other applicable legal rights and these Terms.
11. CHANGE-OF-MIND RETURNS
11.1 Voluntary returns
Outside a statutory cancellation or return right, a non-defective product may be returned only where our stated return policy permits it or Tech Trade Nation expressly agrees to the return.
We are not required to accept a change-of-mind return merely because a customer no longer wants the product where no statutory right applies.
11.2 Opened products
For a voluntary change-of-mind return that is permitted outside a statutory right, an opened product may be subject to a restocking fee of up to 25%, subject to applicable circumstances.
The product should be returned with its original packaging, accessories, manuals, cables, chargers, components and other supplied materials and in a condition reasonably suitable for resale.
If packaging, accessories or other supplied materials are missing or damaged, or the product has been handled beyond what is reasonably necessary to establish its nature, characteristics and functioning, an additional deduction may be applied where legally permissible.
11.3 Software and consumables
Opened software, licences and consumables may be excluded from voluntary change-of-mind returns where legally permitted. This does not limit any statutory consumer right that may apply.
11.4 Data and activation locks
Before returning a device, the customer should remove personal data, accounts, passwords, activation locks and other security controls. Failure to do so may delay processing or prevent us from testing or resetting the device.
12. DEFECTIVE GOODS AND STATUTORY RIGHTS
12.1 CPA rights
Goods are subject to the consumer protections provided by the CPA, including applicable requirements concerning quality, safety, suitability, good working order and durability.
12.2 Six-month implied warranty
Where applicable, qualifying defective goods may be returned within six months of delivery. The Customer may request a repair, replacement or refund, as applicable.
No restocking fee or voluntary-return condition will apply where the Customer is exercising an applicable statutory right.
12.3 Inspection and diagnostics
Where a product is reported as defective, Tech Trade Nation may reasonably inspect, test and diagnose the product to determine the nature, cause and extent of the reported fault.
Testing and inspection may include, where applicable:
- hardware diagnostics and component testing;
- processor, graphics processor and motherboard testing;
- memory (RAM) testing;
- storage device and data-integrity testing;
- display, touchscreen, backlight and pixel testing;
- keyboard, touchpad, buttons, switches and other input-device testing;
- battery, charging, power-delivery and power-supply testing;
- ports, connectors, cables and peripheral-interface testing;
- audio, microphone, camera, speaker and biometric-function testing;
- Wi-Fi, Bluetooth, Ethernet, cellular and other connectivity testing;
- thermal, cooling, fan and temperature testing;
- stress, load, performance and stability testing;
- firmware, BIOS, UEFI and device-controller checks;
- operating-system, driver and software diagnostics;
- boot, startup, shutdown, sleep and recovery testing;
- network, communication and peripheral compatibility testing;
- physical inspection for signs of impact, liquid exposure, corrosion, overheating, tampering, modification or other damage;
- inspection of seals, labels, serial numbers, IMEI numbers, service tags and other identifying information;
- verification of the product’s configuration and components against the original order or supplied specification;
- inspection for missing, substituted or altered components or accessories;
- examination of packaging and accessories where relevant to the reported issue;
- diagnostic logs, error messages, system reports and other technical information;
- testing by Tech Trade Nation, the manufacturer, distributor, authorised service provider or another suitably qualified technician; and
- any other reasonable testing or diagnostic method considered necessary to assess the reported fault.
Testing may require the installation, removal, updating or resetting of software, firmware, drivers or system settings where reasonably necessary. Customers are responsible for maintaining backups of their data before submitting a product for testing, repair or assessment.
The scope and extent of testing will depend on the product, the reported fault and the circumstances of the claim.
Testing may be performed by Tech Trade Nation, a manufacturer, distributor, authorised service provider or suitably qualified technician.
Diagnostic testing does not itself remove a statutory right or determine the outcome of a claim before the relevant facts and legal requirements have been considered.
13. WARRANTY PROCESS AND SHIPPING
13.1 Types of warranty
A product may have one or more of the following:
statutory consumer protection;
a manufacturer warranty;
a distributor or supplier warranty; or
an additional Tech Trade Nation warranty.
Manufacturer or supplier warranties are additional to statutory rights and do not replace rights that cannot lawfully be excluded.
13.2 Manufacturer and distributor RMAs
Some products may require assessment, repair or replacement by the manufacturer, distributor or authorised service centre. Where reasonably practicable, Tech Trade Nation may facilitate the applicable warranty process on the customer’s behalf.
13.3 Faults within 30 days
As an after-sales policy, where a product is dead on arrival or is reported as faulty within 30 days of delivery, Tech Trade Nation may arrange collection and cover reasonable shipping costs, subject always to applicable law and the outcome of the claim.
This policy does not reduce a statutory right.
13.4 Faults after 30 days
For ordinary manufacturer, distributor or voluntary warranty claims after 30 days, the customer may generally be required to arrange delivery of the faulty product to Tech Trade Nation, the manufacturer, distributor or designated service centre. Where applicable under the relevant warranty, Tech Trade Nation may cover or arrange return shipping after the claim has been resolved.
Where a statutory remedy applies, the statutory allocation of risk and expense will take precedence.
13.5 Return packaging
Where the customer is responsible for sending a product to us or another service centre, the product must be packaged adequately to protect it during transit. The customer should retain tracking information and may wish to insure valuable items.
Where permitted by law, Tech Trade Nation is not responsible for damage caused by inadequate customer packaging or by a carrier arranged by the customer.
14. DAMAGE, MISUSE, MODIFICATION AND WARRANTY EXCLUSIONS
Products should be used in accordance with manufacturer instructions and specifications.
Damage, Misuse and Modification
Products must be used, installed, operated and maintained in accordance with the manufacturer’s instructions, specifications, safety requirements and intended use.
Where permitted by law, a warranty claim or voluntary return may be affected where customer-caused damage, misuse, modification, alteration, neglect or improper handling caused or contributed to the reported fault or damage.
Examples include, but are not limited to:
liquid, moisture, humidity or water damage;
physical impact, drops, crushing, bending, pressure or other physical damage;
cracked, broken, damaged or displaced screens, housings, connectors, ports or other components;
incorrect installation, assembly, disassembly or reassembly;
incorrect voltage, current, power source, charger, adapter, power supply or electrical connection;
power surges, unstable power, incorrect wiring, reversed polarity or other electrical damage;
use of incompatible, defective or incorrectly installed components, accessories, cables or peripherals;
unauthorised repairs, servicing, disassembly or attempted repair;
component replacement, modification, alteration or removal;
damage to, removal of, or interference with heatsinks, thermal pads, thermal paste, cooling systems or other cooling components;
overclocking, overvolting, undervolting or other performance adjustments outside manufacturer specifications;
operation outside the manufacturer’s specified temperature, voltage, power, environmental or operating limits;
BIOS, UEFI, firmware, microcode or controller modification or flashing;
installation of unofficial, modified or incompatible firmware, drivers or software where this causes or contributes to the reported fault;
application of liquid metal or other non-standard thermal materials;
aftermarket cooling systems or other hardware modifications;
modification, cutting, drilling, soldering, rewiring or alteration of a product, chassis, PCB, connector, cable or component;
cryptocurrency mining or other sustained workloads where the resulting use, heat, load or operating conditions caused or contributed to the reported fault;
excessive dust, dirt, debris, corrosion, pest damage or inadequate maintenance where applicable;
exposure to heat, cold, moisture, chemicals, smoke or other unsuitable environmental conditions;
misuse, abuse, neglect or operation for a purpose for which the product was not designed;
unauthorised modification of security features, serial numbers, identification labels or other product identifiers;
removal, alteration or tampering with labels, serial numbers, seals or other identifying markings;
installation or use of counterfeit, incompatible or materially defective components;
damage caused by third-party equipment, accessories, software, modifications or services;
accidental damage occurring after delivery;
damage arising from incorrect transport, storage, handling or packaging by the Customer; or
any other alteration, use or condition that caused or contributed to the reported fault or damage.
Where a product has been modified, repaired, damaged or otherwise altered, Tech Trade Nation may inspect the product and relevant components to determine whether the condition caused or contributed to the reported fault.
A modification, damaged component or breach of manufacturer instructions does not, by itself, automatically determine the outcome of a claim. The relevant condition, the reported fault and the relationship between them will be considered based on the available evidence and applicable law.
Where customer-caused damage or modification is determined to have caused or contributed to the reported fault, the affected fault or component may not be covered by a manufacturer’s, supplier’s or Tech Trade Nation warranty, to the extent permitted by law.
Nothing in this section limits any statutory right or remedy that cannot lawfully be excluded.
15. CUSTOM-BUILT SYSTEMS
15.1 Assembly and workmanship
Where Tech Trade Nation assembles a custom PC or other system, the quotation, product page or invoice may specify a separate assembly, workmanship or build warranty.
15.2 Individual components
Individual components remain subject to the applicable manufacturer, distributor or supplier warranty in addition to any build warranty.
15.3 Diagnostics and faults
A failure of one component does not automatically mean that all components in the system are defective. Tech Trade Nation may perform reasonable diagnostic testing to identify the source of a reported fault.
15.4 Customer modifications
Customer modifications after delivery may affect an assembly or component warranty where the modification caused or contributed to the fault and the law permits the warranty to be affected.
16. USED, REFURBISHED, OPEN-BOX AND EX-DISPLAY GOODS
Products identified as used, pre-owned, refurbished, open-box, demo or ex-display will be sold according to the condition disclosed at the time of sale.
Known material cosmetic or functional characteristics will be disclosed where applicable.
A product’s used or refurbished status does not by itself remove statutory consumer protections that apply to the transaction.
17. RETURNS, REFUNDS AND PRODUCT VERIFICATION
17.1 Refund method
Where a refund is due, it will generally be processed using the original payment method or, where appropriate, by EFT to a verified bank account belonging to the customer.
Where the original payment was made in cash, a cash refund may be provided where appropriate.
17.2 Refund timing
Refunds will be processed within the period required by applicable law. Banking and payment-provider processing times may affect when refunded funds appear in the customer’s account.
17.3 Identity and ownership verification
We may request reasonable information to verify the customer’s identity, payment, ownership and transaction details before processing a refund.
17.4 Product identification
Returned goods may be checked against the original order, serial number, IMEI, service tag, model number, component configuration, photographs and other product identifiers recorded at the time of sale.
17.5 Suspected abusive returns
We expressly reserve the right to investigate any suspected fraudulent, dishonest, or abusive return activity, including but not limited to:
Returning a different product than the one originally purchased;
Serial-number or component substitution, including removing, swapping, or tampering with parts, accessories, or identifiers;
Deliberate damage to a product in order to manufacture grounds for a return;
False or fabricated defect claims;
Repeated abusive returns, including patterns of excessive, opportunistic, or bad-faith return requests; or
Attempting to obtain a refund or credit for any product not purchased from Tech Trade Nation.
We may, at our sole discretion, deny any return, refund, or credit, suspend or terminate return privileges, close associated accounts, and pursue all available legal remedies—including civil and criminal action—against any person who engages in such conduct.
Nothing in this section limits, waives, or overrides any right afforded to consumers under applicable law.
18. TRADE-IN PROGRAMME
18.1 Eligibility
Tech Trade Nation may, at its discretion, accept eligible PCs, laptops, smartphones, tablets, graphics cards, CPUs, motherboards, RAM, storage devices, gaming equipment, monitors, peripherals or any other applicable product for cash, trade-in credit, purchase credit or another agreed consideration.
Acceptance is subject to inspection, verification and eligibility.
18.2 Ownership
A person submitting a trade-in warrants that they are the lawful owner of the product or are legally authorised to dispose of it.
Customers must not submit stolen, unlawfully obtained, counterfeit or unlawfully encumbered goods, or goods subject to another person’s ownership rights where disposal is prohibited.
We may request reasonable proof of ownership or identity and may suspend a transaction where ownership is disputed or unlawful possession is reasonably suspected.
18.3 Valuation
Trade-in values are determined at our sole discretion and may be based on any factors we deem relevant, including but not limited to:
Make and model;
Age and specifications;
Current market demand and prevailing market prices;
Condition and functionality, including battery health and storage capacity;
Cosmetic condition;
Accessories included (or missing);
Warranty status and repair history;
Serial-number verification, including confirmation that the device is not reported lost or stolen, is not blacklisted, and is not subject to any outstanding finance or ownership dispute;
Availability of replacement parts; and
Any other factor we reasonably consider relevant.
Trade-in values are indicative only until the device has been received, inspected, and verified by us. We reserve the right to revise, reduce, or withdraw any quoted trade-in value, including to zero, where the device does not match the description provided, fails inspection or verification, or where any of the above factors differ from those represented. Our determination of trade-in value is final, subject only to any right of appeal or remedy you may have under applicable law.
18.4 Quotes and final valuation
All preliminary trade-in quotes are indicative only and are not binding on Tech Trade Nation.
Every preliminary quote is subject to physical inspection, testing, and verification of the device once received. The final trade-in value may be adjusted, upward or downward, including to zero, where the device materially differs from the information supplied by the customer, fails inspection or verification, or is subject to any factor set out in our trade-in valuation criteria.
Where the revised value is lower than the preliminary quote, we will inform the customer of the revised value before final acceptance. The customer is under no obligation to accept the revised offer, and a preliminary quote does not constitute a binding offer, an acceptance, or a waiver of any of our rights. If the customer declines the revised offer, we may return the device in accordance with our returns and shipping policy, and any applicable fees may apply.
18.5 Trade-in condition
We reserve the right to reject any product, or to value it differently, including at zero, where the product is affected by any undisclosed condition, including but not limited to:
Undisclosed damage of any kind;
Liquid damage or moisture ingress, whether or not visible;
Missing, non-functional, or replaced components;
Activation locks, account locks, or any other software or network restriction that prevents full use or resale;
Materially different specifications from those represented by the customer;
Altered, defaced, removed, or mismatched serial numbers;
Counterfeit, non-genuine, or unauthorised components;
Significant corrosion;
Severe physical damage, including cracked, bent, or structurally compromised casings; and
Any other material condition that was not disclosed by the customer.
Where any such condition is identified, we may reject the product outright, revise the trade-in value, or return the product to the customer, in each case in accordance with our trade-in, inspection, and returns policies. The customer bears full responsibility for the accuracy and completeness of all information supplied regarding the product, and any failure to disclose a material condition may result in the rejection of the trade-in or the revision of the value offered.
18.6 Trade-in data
Customers are solely responsible for removing personal information, signing out of accounts, and removing activation locks before handing over a trade-in.
Once a trade-in has been accepted, Tech Trade Nation may erase, reset, refurbish, recycle, or otherwise process the product. To the maximum extent permitted by law, Tech Trade Nation accepts no responsibility or liability for any personal information, data, accounts, or digital content left on a trade-in after possession has transferred. The customer bears all risk arising from any failure to remove such information.
18.7 Trade-in payment
An accepted trade-in may be paid by EFT, store credit, cash, purchase discount or another agreed method, subject to completion of the required verification and acceptance process.
19. PROMOTIONS, DISCOUNTS AND SPECIAL PRICING
Promotions may be subject to additional terms, which may include expiry dates, product exclusions, minimum spend requirements, quantity limits, one-per-customer restrictions, stock limitations, and eligibility criteria. Such terms form part of the promotion and apply in addition to these general terms.
Promotional terms do not override, exclude, or limit any mandatory consumer rights, and nothing in a promotion or these terms may be read as doing so.
We reserve the right to correct, suspend, withdraw, or cancel any promotion, in whole or in part, where a genuine technical, pricing, or administrative error has occurred, or where the promotion is being abused, exploited, or used contrary to its terms. Where we correct or withdraw a promotion, we will do so in accordance with applicable law and, where required, provide any remedy mandated by such law.
20. DATA, PRIVACY AND ELECTRONIC COMMUNICATIONS
20.1 Customer data
We process personal information in accordance with applicable South African privacy law, including the Protection of Personal Information Act, 2013 (POPIA), and all other applicable data protection laws.
Personal information may be processed for legitimate purposes, including but not limited to:
Order processing and fulfilment;
Payment processing and verification;
Delivery and logistics;
Customer support and dispute resolution;
Returns, refunds, and warranty administration;
Trade-in valuation and verification;
Fraud prevention, detection, and investigation;
Accounting, auditing, and record-keeping;
Legal compliance and responding to lawful requests; and
Any other purpose permitted or required by applicable law.
This processing is carried out in accordance with POPIA and as explained further in our Privacy Policy, which forms part of these terms. Where POPIA or any other applicable law requires consent, notification, or any other precondition for processing, we will comply with that requirement before processing.
Nothing in this section limits, waives, or overrides any right afforded to data subjects under POPIA or any other applicable law, including the right to access, correct, or object to the processing of personal information
20.2 Data backups
Customers are solely responsible for maintaining adequate backups of all important information, data, and content before handing over any product for repair, replacement, diagnostics, resetting, or any other service.
Repair, replacement, diagnostics, resetting, refurbishment, testing, or any product failure may result in data becoming inaccessible, altered, corrupted, or permanently lost. Customers accept this risk entirely.
To the maximum extent permitted by law, Tech Trade Nation accepts no responsibility or liability for any loss, corruption, alteration, or inaccessibility of customer data, however arising, including where such loss results from our acts, omissions, or negligence. Where such liability may lawfully be excluded, it is excluded.
20.3 Electronic communications
We may communicate electronically regarding orders, payments, delivery, returns, warranties, trade-ins, accounts and customer service.
Direct marketing will be conducted in accordance with applicable law and, where required, customers will be given an appropriate mechanism to opt out.
21. INTELLECTUAL PROPERTY AND THIRD-PARTY SERVICES
All content on this website belonging to Tech Trade Nation—including original text, photographs, images, graphics, branding, logos, layouts, designs, code, and compilations—is owned by or licensed to Tech Trade Nation and may be protected by copyright, trademark, and other intellectual-property laws.
You may not reproduce, copy, distribute, publish, transmit, modify, adapt, scrape, frame, mirror, sell, license, or otherwise exploit any such content, in whole or in part, for any commercial purpose without our prior written consent. We reserve all rights not expressly granted.
Unauthorised use may result in legal action, including claims for damages, account termination, and injunctive relief, to the fullest extent permitted by law.
All third-party trademarks, brand names, product names, and logos remain the property of their respective owners. Their use on this website does not imply affiliation, endorsement, sponsorship, or approval by Tech Trade Nation, and does not grant any licence or right of use to any third party.
We may engage third-party providers for payments, courier and delivery services, hosting, email, analytics, fraud prevention, cloud services, marketing, product information, and other operational functions. These providers may operate under their own terms and privacy policies.
Where third-party providers process personal information on our behalf, we remain responsible for ensuring that such processing complies with POPIA and other applicable law, and we take reasonable steps to ensure our providers offer adequate protection for personal information.
This website may contain links to third-party websites. Such links are provided for convenience only and do not constitute endorsement, approval, or verification of those websites or their content.
We accept no responsibility or liability for the content, availability, accuracy, security, privacy practices, terms, or products and services of any third-party website. Accessing any third-party website is entirely at your own risk and subject to that website’s terms and policies.
Nothing in this section limits, waives, or overrides any right afforded to consumers or data subjects under applicable law.
22. WEBSITE AVAILABILITY, LIABILITY AND FORCE MAJEURE
22.1 Website availability
We do not warrant or guarantee that the website will be available at all times, uninterrupted, timely, or free from errors, defects, viruses, or harmful components.
The website may be temporarily or permanently unavailable, restricted, or degraded as a result of:
Scheduled or emergency maintenance;
Hosting, server, or software failures;
Network, connectivity, or telecommunications failures;
Cyber incidents, attacks, or security breaches;
Infrastructure or power failures;
Third-party service provider failures; or
Any other circumstances beyond our reasonable control, including force majeure events.
To the maximum extent permitted by law, we accept no responsibility or liability for any loss, damage, or inconvenience arising from the unavailability, interruption, suspension, or discontinuation of the website, however caused.
We reserve the right to modify, suspend, restrict, or discontinue all or any part of the website at any time, with or without notice, and without liability to you.
22.2 Limitation of liability
Any limitation or exclusion of liability in these Terms applies only to the maximum extent permitted by South African law.
Nothing in these Terms excludes, limits, or purports to exclude or limit:
Any statutory consumer right or statutory remedy;
Any liability that cannot lawfully be excluded or limited, including liability for gross negligence, wilful misconduct, or fraud;
Any liability arising under section 61 of the Consumer Protection Act; or
Any other mandatory legal obligation.
Subject to the foregoing, and to the maximum extent legally permissible, Tech Trade Nation will not be liable for any indirect, incidental, special, or consequential loss, including loss of profits, loss of revenue, loss of data, or loss of business opportunity, however arising, where such liability may lawfully be excluded.
22.3 Force majeure
Tech Trade Nation will not be responsible or liable for any delay, failure, or non-performance caused by extraordinary circumstances beyond its reasonable control, including but not limited to:
Natural disasters, fires, floods, earthquakes, or severe weather;
Widespread infrastructure, utility, power, or telecommunications failures;
Supplier, manufacturer, or courier disruption, including strikes, shortages, or transport failures;
Civil unrest, riots, war, terrorism, or armed conflict;
Government action, sanctions, embargoes, or regulatory restrictions;
Cyber incidents, attacks, ransomware, or security breaches;
Epidemics, pandemics, or public-health emergencies; or
Any other event or circumstance beyond our reasonable control that materially prevents or delays performance.
Where a force-majeure event occurs, our obligations under these Terms are suspended for the duration of the event, and any affected timelines or deadlines are extended accordingly. We will use reasonable efforts to notify affected customers and to resume performance as soon as reasonably practicable.
If a force-majeure event continues for an extended period, we may cancel or terminate the affected order or service without liability, subject to any remedy that cannot lawfully be excluded, and will refund any amounts paid for goods or services not supplied.
23. CUSTOMER RESPONSIBILITIES
Customers are solely responsible for:
Providing accurate, complete, and current information, including when placing orders, requesting services, or submitting trade-ins;
Reviewing all orders before submission, including product, quantity, price, specifications, and delivery details;
Providing correct and complete delivery details, including address, contact number, and any access instructions;
Checking compatibility of products, parts, accessories, and software with their intended use before purchase;
Maintaining adequate backups of all important data and content before handing over any product for service, repair, or trade-in;
Protecting account credentials, including passwords, PINs, and authentication details, and notifying us promptly of any suspected unauthorised access;
Using products strictly in accordance with manufacturer instructions, including installation, operation, maintenance, and safety guidelines; and
Using products lawfully and appropriately, and not for any unlawful, prohibited, or improper purpose.
Customers accept responsibility for any loss, damage, cost, or liability arising from their failure to comply with the above. Where a customer’s failure to comply causes loss or damage to Tech Trade Nation or a third party, the customer may be liable for that loss or damage to the extent permitted by law.
Nothing in this section transfers to the customer any responsibility, duty, or liability that remains with Tech Trade Nation under applicable law, including under the Consumer Protection Act.
24. COMPLAINTS AND DISPUTE RESOLUTION
Customers are encouraged to contact Tech Trade Nation first so that a complaint can be investigated and, where reasonably possible, resolved promptly and in good faith.
To help us investigate and resolve a complaint efficiently, a complaint should include:
The customer’s full name and contact details;
The order number, invoice number, or trade-in reference;
Details of the relevant product or service;
A clear description of the issue, including dates and any supporting evidence; and
The resolution or outcome the customer is seeking.
We will acknowledge complaints within a reasonable time and use reasonable efforts to investigate and respond. Where a complaint cannot be resolved to the customer’s satisfaction, we will explain the reasons for our decision and any further steps available.
Nothing in these Terms prevents, restricts, or delays a consumer from approaching a competent regulator, ombud, tribunal, court, or other legally authorised dispute-resolution body, including the National Consumer Commission, the Consumer Goods and Services Ombud, or the Information Regulator, where applicable. A customer is not required to exhaust our internal complaints process before doing so.
25. CHANGES, SEVERABILITY, GOVERNING LAW AND CONTACT
25.1 Changes to these Terms
We reserve the right to update, revise, amend, or replace these Terms at any time, at our sole discretion.
The latest version will be published on the website with its effective date and will supersede and replace all prior versions with effect from that date. Continued use of the website, or continued engagement with our products or services, after the effective date constitutes your acceptance of the updated Terms.
Updated Terms apply prospectively only. They do not apply retrospectively, do not remove, extinguish, or diminish any rights or remedies that have already accrued to either party, and do not override, exclude, or limit any mandatory legal requirement or any right that cannot lawfully be excluded.
We may, but are not obliged to, notify registered users of material changes by email, account notification, or website notice. It remains the customer’s responsibility to review the current Terms periodically.
25.2 Severability
If any provision is found to be invalid, unlawful or unenforceable, it will be limited or severed only to the extent necessary and the remaining provisions will continue to apply.
25.3 No waiver
A failure or delay by Tech Trade Nation to enforce a provision does not permanently waive that provision or any other right.
25.4 Entire agreement
These Terms, together with applicable transaction-specific terms, quotations, product information and other documents incorporated into the transaction, form the agreement governing the relevant transaction, subject to mandatory law.
25.5 Governing law
These Terms are governed by the laws of the Republic of South Africa. Any dispute will be dealt with through the appropriate forum having jurisdiction.
25.6 Customer acknowledgement
By placing an order or otherwise entering into a transaction with Tech Trade Nation, the customer acknowledges that they have had a reasonable opportunity to review these Terms and the transaction information applicable to the purchase.
Where required by law, customers will be provided with an appropriate opportunity to review and correct transaction information before final submission.
